Florida Set to Test SCOTUS with Death Penalty Pursuit in Child Sexual Assault Case

Under a new law that defies the U.S. Supreme Court’s current Eighth and Fourteenth Amendment precedent, prosecutors in the Sunshine State will be seeking the death penalty against a man accused of raping a child in a case that is first of its kind for the state of Florida.

In court documents filed on Thursday, the Fifth Judicial Circuit State Attorney’s Office declared that it intended to pursue the death penalty against 36-year-old Joseph Andrew Giampa. The grand jury had indicted Giampa on six counts of sexual battery on a child under the age of twelve and three counts of encouraging a child’s sexual performance.

The state attorney’s office sent a news release stating that Giampa’s execution is the goal of the prosecution because of “the severity of the crime and its impact on the community.”

Prosecutors claim that the notice, which was filed in Lake County Circuit Court, enumerates multiple aggravating circumstances that beg the state to pursue the death penalty. These elements include the fact that Giampa had previously been found guilty of a violent felony, that the offense was undertaken for “pecuniary gain,” that it was “especially heinous,” and that the victim was “particularly vulnerable.”

State Attorney William “Bill” Gladson said in a statement, “The decision to pursue the highest penalty reflects the gravity of the charges and the State Attorney’s Office’s dedication to holding criminals accountable for their actions.” The impact this situation has on the community and its sensitivity is acknowledged by the State Attorney’s Office. We are steadfast in our commitment to upholding justice and safeguarding the weak.

Authorities were called to Giampa’s residence on November 2 over a possible sexual battery, according to a probable cause affidavit that Law&Crime was able to obtain. Deputies arrived and arrested Giampa. Deputies claimed he had a computer in his trailer that included a video of an adult sexually abusing a child under the age of twelve.

The attacker who was filming the assault “put the camera down” and then “walked in front of the camera” after the sexual assault. According to the authorities, Giampa was the adult guy on the recording.

The juvenile was then shown on tape being sexually attacked multiple times by Giampa, who left the room as “the juvenile victim begins cleaning up in view of the camera.”

The legislation that Gov. Ron DeSantis signed earlier this year clearly violates the Supreme Court’s 2008 ruling in Kennedy v. Louisiana, which forbids the death penalty as a punishment “where no life was taken in the commission of the crime.” As a result, the case is certain to present constitutional challenges.

The court concluded in a 5-4 decision that a death sentence for someone who sexually assaulted a child without killing it and who had no intention of helping another person kill the kid was unconstitutional under the Eighth and Fourteenth Amendments. This conclusion was reached based on both consensus and our own independent judgment.

All five of the justices who voted in favor have been replaced, primarily by justices with significantly more conservative judicial ideologies overall. Of the four justices who dissented, Samuel Alito, John Roberts, Antonin Scalia, and Clarence Thomas, three remain on the court.

The language of the bill makes it clear that the previous decisions made by the supreme court regarding the death sentence were “erroneously decided and that such cases are an egregious infringement of the states’ power to punish the most heinous of crimes.”

DeSantis has already declared his intention to present the case to the judges in a statement.

“In a case of sexual battery against a kid under the age of twelve, the State’s Attorney for the Fifth Judicial Circuit declared today that they will pursue the death penalty,” the man stated on Facebook. This will be the first case to be heard before the US Supreme Court since I approved laws granting the death penalty to pedophiles. I wholeheartedly endorse the State’s Attorney.”

Human rights organizations had urged for mercy, but on Wednesday an Iranian lady who had been forced into marriage as a child and was imprisoned for killing her husband was put to death.

Iran Human Rights (IHRNGO), a Norwegian organization, claims that Samira Sabzian was hung at Ghezelhesar Prison.

Sabzian was the victim of “gender apartheid, child marriage, and domestic violence,” according to IHRNGO Director Mahmood Amiry-Moghaddam.

“[T]he murdering machine of the corrupt and inept dictatorship claimed her life today. A tyranny that has survived only by murdering people and inciting terror,” Amiry-Moghaddam said in a statement. “Ali Khamenei and other leaders of the Islamic Republic must be held accountable for this crime.”

Sabzian was imprisoned for ten years after her husband’s murder. According to IHRNGO, Sabzian suffered from domestic abuse and was coerced into marriage at the age of 15. At the time of her arrest, she was the mother of two small children, one of whom was a newborn. For a decade, Sabzian was separated from them until they visited the prison to bid her farewell before her execution.

“Alarmed” by the execution, the UN High Commissioner for Human Rights’ office expressed.

“We again urge Iran to establish a moratorium on all executions to abolish the death penalty,” according to the office.

According to IHRNGO, Iran has carried out about 200 executions of women since 2010, making it one of the countries that executes the most women worldwide. Even in situations of domestic abuse and violence, women are not entitled to divorce; in more than half of those cases, the women were found guilty of killing their husbands.

According to accounts, on Tuesday night, a jackknifed tractor-trailer spilled diesel fuel across the highway and into the Passaic River, causing a 13-car pileup. According to sources, police and emergency personnel from New Jersey came to the scene.

A jackknifed tractor-trailer is seen obstructing both lanes of traffic in the Freedom News TV footage of the incident. A further view shows a firefighter from Paterson, New Jersey, sledding across a black ice-covered roadway.

A car on a flatbed tow truck with its entire rear end shattered and all of its airbags deployed is also seen in the footage.

A portion of the road flooded while Sarvjeet Singh, who was interviewed for the video, was driving. Before coming to a section of the road that was frozen, he indicated that he and other cars had driven through.

As more automobiles started crashing into one another, he continued, “All of a sudden they couldn’t control their cars.” He then pulled into a driveway. “I found out before that, there was a tractor-trailer that got hit by a car and there was a bad injury there.”

He noticed as he pulled into the driveway that the automobiles were smashing behind him.

He believed something was wrong with his brakes after driving through the water, but then he began to slip and discovered the road was slick.

Crushed bumpers, flat tires, broken lamps, and dented fenders are among the damaged cars seen in more footage that is captured on the black ice.

Cars were pointing in the direction opposite to the flow of traffic, and some cars were sideways on the road.

Additionally, fluid-cleaning crews were observed underneath the tractor-trailer. They were observed shoveling and sweeping a quick-dry material that is meant to absorb fluids like oil and other substances that can pollute the environment or create dangerous circumstances on routes.

On camera, a crew member is seen pointing to an area and inquiring as to whether it contained diesel. Photo evidence indicated that the tractor-trailer’s fuel tank was dented, resulting in fuel spilling onto the roadway.

Roadway sanding was done by salt trucks following the collision. Photos posted on the Paterson Police Department’s Facebook page depict officers responding to a coastal storm that passed through the region on Monday, which resulted in significant flooding and hazardous drivers.

After discovering her two five-year-old twins dead in the family’s apartment late on Monday night, a mother in New York City was devastated.

At approximately 11:20 p.m. on Monday, the New York City Police Department informed Fox News Digital that police responded to a 911 report for an assisted kid at 240 East 175th Street.

Officers discovered a five-year-old brother and sister who were both unconscious and unresponsive when they arrived. According to later reports from the authorities, the kids were “foaming at the mouth” when their mother discovered them.

EMS arrived and declared the children who had received assistance dead on the spot. An unidentified woman reported to authorities that her kids were throwing up and that she might have given them Tylenol.

No foul play is suspected by the police. Chief of Detectives for the New York Police Department Joseph Kenny stated that all reports show the mother was “well engaged with everything to do with these children.”

“She was an active participant with their medical care, an active participant in their schooling,” he stated. Their family was calm and caring, and neighbors claimed she was a devoted mother. Right now, it just seems like a medical disaster until the medical examiner says otherwise.”

The NYPD informs Fox News Digital that the cause of death will be ascertained by the Office of the Chief Medical Examiner. The probe is still going strong.
